A legal disclaimer
This User Agreement (“Agreement”) sets out the terms and conditions (“Terms”) governing the membership services (“Services”) and online content provided by the National Leadership Society of First Generation College Students, also known as FirstGen Society. These Services include both free content and paid membership content, as well as related benefits, features, and resources offered through our website.
By accessing or using the Services, you (“the User” or “Member”) acknowledge that you have read, understood, and agree to be bound by these Terms. The purpose of this Agreement is to define the relationship between the User or Member and FirstGen Society and to ensure that you understand what you can expect from us.
Acceptance of Terms
By accessing or using the tools, features, and services available on www.firstgensociety.org (“the Site”), including but not limited to the member area and all related Services, you (“the User” or “Member”) agree to be bound by these Terms, whether you are visiting the Site or accessing it as a registered Member.
If you are using the Site on behalf of a business, school, organization, or other legal entity, you represent and warrant that you are authorized to accept these Terms on its behalf. If you do not agree to these Terms, or if you are not authorized to accept them, you must discontinue use of the Site and Services.
Authority and Agreement to Modifications
By accepting these Terms, you represent that you have the legal capacity to enter into this Agreement. If you are acting on behalf of a separate legal entity, you further represent that you have the authority to bind that entity to this Agreement.
FirstGen Society reserves the right to modify, update, or revise these Terms at any time, with or without prior notice. You acknowledge and agree that it is your responsibility to review the Site and these Terms periodically to stay informed of any changes. Your continued use of the Site or Services after any modifications constitutes your acceptance of the updated Terms.

Membership
By accessing or using any of the Services, the Member acknowledges and agrees to be bound by these Terms, including any future amendments. If the Member does not agree to these Terms, they must immediately discontinue use of their membership, the Site, and all Services provided by FirstGen Society. To terminate membership, the Member may contact us at info@firstgensociety.org and request cancellation.
Membership Services & Fees
FirstGen Society provides both free and paid content and services. These may include chapter and club activities, in‑person and online programming, and other offerings such as webinars, speaker events, conferences, newsletters, and similar initiatives. FirstGen Society reserves the right to modify any free or paid content or services at its discretion. The organization does not guarantee that content currently offered free of charge (“Free Content”) will remain free, nor that content requiring payment (“Paid‑for Content”) will remain paid.
The User or Member agrees to pay all applicable membership, chapter, or club fees (“Dues”) at the rates in effect at the time charges are incurred. The User or Member must provide complete and accurate payment information and may pay by credit card, debit card, or standing order. By submitting payment details, the User or Member warrants that they are authorized to use the selected payment method for the purchase of Paid‑for Content and Services. In the event of an unauthorized payment, FirstGen Society reserves the right to suspend or terminate access to the Site and any Paid‑for Content and Services.
If payment authorization is not received or is later revoked, FirstGen Society may immediately suspend or terminate access to Paid‑for Content and Services and/or the Site. While FirstGen Society will make reasonable efforts to process requests for Paid‑for Content and Services promptly, it does not guarantee availability within a specific timeframe. A contract for Paid‑for Content and Services becomes effective when a Username and Password are issued to the User or Member. Once Dues have been paid for a defined membership period that includes Paid‑for Content and Services, the User or Member has no right to cancel the supply of such content other than by cancelling their membership in accordance with these Terms. This does not affect any statutory rights the User or Member may have.
Registration, Passwords, & Privacy
Use of the Site signifies the User’s or Member’s consent to FirstGen Society’s collection and use of personal information in accordance with its Privacy Policy. The Privacy Policy is available for review on the Site. Registration is not required to access general Site content; however, access to Paid‑for Content and Services requires the User or Member to provide accurate and complete registration information, including current contact details. It is the User’s or Member’s responsibility to update and maintain this information. FirstGen Society is entitled to rely on the accuracy of the information provided to deliver Paid‑for Content and Services.As part of the registration process, the User or Member will be asked to create a password in a format specified by FirstGen Society (“the Password”).
The User or Member must keep the Password confidential and must not disclose it to any other person or entity. If the User or Member becomes aware of, or reasonably suspects, unauthorized access to their Password, they must notify FirstGen Society immediately at info@firstgensociety.org. If FirstGen Society has reasonable grounds to believe that a Password has been misused or compromised, it may require the User or Member to change the Password or may suspend access to the Site, including Paid‑for Content and Services, until FirstGen Society is satisfied that the security of the Site is no longer at risk.
Registration, Passwords, & Privacy
Use of the Site signifies the User’s or Member’s consent to FirstGen Society’s collection and use of personal information in accordance with its Privacy Policy. The Privacy Policy is available for review on the Site. Registration is not required to access general Site content; however, access to Paid‑for Content and Services requires the User or Member to provide accurate and complete registration information, including current contact details. It is the User’s or Member’s responsibility to update and maintain this information. Limitations on Use of the Site
All content and services provided by FirstGen Society are the property of FirstGen Society or are licensed to FirstGen Society by third‑party licensors. FirstGen Society and its licensors retain all intellectual property rights in such content and services. All content and services are provided solely for the personal use of the User, Member, or FirstGen Society chapters and clubs.
The User, Member, or FirstGen Society chapters and clubs may not sub‑license, distribute, sell, supply, modify, adapt, amend, incorporate, merge, or otherwise alter any content or service provided under this Agreement. They may not remove, obscure, or replicate any logos, copyrights, proprietary notices, legends, symbols, labels, watermarks, signatures, or similar marks affixed to or embedded in the content or services.
The User, Member, or FirstGen Society chapters and clubs shall not engage in any act or omission, or permit any act or omission, that infringes or is likely to infringe upon the intellectual property rights owned or used by FirstGen Society or its licensors, including Wix.com, or any rights relating to the Site.
Limitation of Liability and Indemnity
The User or Member expressly agrees that use of, and browsing on, the Site is undertaken at their own risk. Neither FirstGen Society nor any party involved in creating, producing, or delivering the Site shall be liable for any direct, incidental, special, consequential, indirect, or punitive damages arising from the User’s or Member’s access to, use of, or inability to use the Site or any linked site. This includes, without limitation, damages related to the procurement of substitute goods or services; any goods or services purchased or obtained through the Site; messages received; transactions entered into; or any unauthorized access to or alteration of transmissions or data. Such damages may include loss of profits, loss of use, loss of data, loss of intangible property, and any related legal costs or expenses, even if FirstGen Society has been advised of the possibility of such damages.
The User or Member further acknowledges that downloading any material from the Site is done at their own risk. Neither FirstGen Society nor any party involved in creating, producing, or delivering the Site, including Wix.com, shall be liable for any direct, incidental, special, consequential, indirect, or punitive damages arising from the downloading of material from the Site or any linked site, including but not limited to loss of profits, loss of use, loss of data, loss of intangible property, and related legal costs or expenses.
All content on the Site is provided on an “as is” and “as available” basis without any warranty of any kind, whether express or implied, including but not limited to implied warranties of satisfactory quality, fitness for a particular purpose, or non‑infringement. Some jurisdictions do not allow the exclusion of implied warranties; therefore, certain exclusions may not apply to all Users or Members. Users and Members are responsible for reviewing their local laws regarding such limitations.
While FirstGen Society uses reasonable efforts to provide accurate and up‑to‑date information on the Site, it makes no warranties or representations regarding the accuracy, completeness, or reliability of such information. FirstGen Society is not responsible for any errors, omissions, or outcomes resulting from the use of information provided on the Site. All information is supplied with the understanding that it does not constitute advice, recommendations, or arrangements by FirstGen Society or its affiliates, and should not be relied upon when making decisions. Users and Members must independently evaluate whether to rely on any information posted on the Site. FirstGen Society may modify Site content at any time but is under no obligation to update it.
No party other than FirstGen Society involved in the operation of the Site shall be liable or responsible for any content, including Paid‑for Content and Services, or for the User’s or Member’s use of the Site.
Indemnity
The User or Member agrees to indemnify, defend, and hold harmless FirstGen Society, its parent companies, subsidiaries, affiliates, and their respective officers, directors, employees, owners, agents, information providers, and licensors, including Wix.com, (collectively, the “Indemnified Parties”) from and against any and all claims, damages, liabilities, losses, costs, and expenses (including legal fees), whether foreseeable or not, incurred by any Indemnified Party arising out of or related to:

the User’s or Member’s use of, connection with, or conduct on the Site; or

any breach by the User or Member of these Terms
FirstGen Society or Wix.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User or Member. In such cases, the User or Member agrees to cooperate fully with the defense of the claim.
Consequences of Breach of these Terms
If FirstGen Society or Wix.com determines, in their sole discretion, that the User or Member has breached, violated, or contravened this Agreement, or has otherwise engaged in inappropriate conduct in connection with the Site or its content or services, they reserve the absolute right to:

issue a warning to the User or Member regarding the violation and request that the conduct

discontinue the User’s or Member’s membership and/or access to any related services, including Paid‑for Content and Services

take any measures deemed necessary, including terminating, suspending, or restricting access, to prevent the User or Member from using or linking to the Site
Third-Party Services
The provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this Agreement, except with respect to the rights of Wix.com.
Certain Services may integrate with, rely on, or be provided in connection with third‑party websites, services, content, or materials (“Third‑Party Services”). FirstGen Society does not control, endorse, or assume responsibility for any Third‑Party Services. We make no representations regarding the quality, content, nature, reliability, or legality of Third‑Party Services accessible through our Site or connected to our Services. No affiliation, endorsement, or adoption of Third‑Party Services by FirstGen Society is implied, and we are not responsible for any content provided on or through such services.
Users and Members are responsible for reviewing the terms of use, privacy policies, and legal agreements that apply to any Third‑Party Services they choose to engage with.
Third‑Party Advertisers
FirstGen Society may allow third‑party advertisers or partners to display advertisements on the Site. FirstGen Society is not responsible for any interactions, transactions, or dealings between the User or Member and such third‑party advertisers, including any purchases made online or otherwise. The User or Member agrees that FirstGen Society shall not be liable for any loss or damage arising from such dealings.
Proper Law and Jurisdiction
This Agreement and all matters arising from it shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Entire Agreement
This Agreement supersedes all prior agreements, arrangements, and understandings and constitutes the entire agreement between the parties regarding its subject matter. The User or Member confirms that they have not entered into this Agreement in reliance on any representation that is not expressly included herein.
Termination of Membership or Website Use
A Member may terminate their membership at any time and for any reason by submitting written notice to FirstGen Society. FirstGen Society may, at its sole discretion, terminate a Member’s membership, account, or access to the Site at any time, with or without cause, and with or without prior notice or explanation, and without liability.
Upon termination of this Agreement for any reason, the Member must immediately cease all use of the Services and the Site. No refunds will be issued for any fees or payments already made in connection with the terminated Agreement.
Membership Refund Policy
Members wishing to cancel their membership must submit a refund request in writing to info@firstgensociety.org or through the Contact Us page. FirstGen Society offers a full refund of membership fees if the request is submitted within 30 days of the initial payment.
While not required, Members are encouraged to include the reason for cancellation to help FirstGen Society improve the member experience. After the 30‑day period has passed, the refund window closes and no further refund requests will be eligible.
Credit Card and Check Payment Refunds
Credit card refunds will be issued to the same card used for the original transaction. If the original credit card is no longer valid, a refund will be issued by check. Cash refunds will not be provided for credit card payments.
Refund checks will be mailed to the address provided in the online membership form.
For credit card refunds, please allow one full billing cycle for the credit to appear on your account. Billing cycle timing varies by bank or credit card provider. For additional information, please contact your bank or credit card company directly.
Member Profile Privacy
In accordance with FirstGen Society’s privacy protection practices, Members have the following rights:

The right to know what personal information is collected, used, shared, or sold.

The right to request deletion of personal information held by FirstGen Society and its service providers.

The right to opt out of communications sent by FirstGen Society and its service providers.

The right to non‑discrimination in price or service when exercising any privacy right.

Please review our Privacy Policy, which explains how FirstGen Society collects, uses, and protects your personal information in connection with the services and membership benefits offered through the Site (“Services”). For purposes of the Privacy Policy, “Personal Information” includes any information that identifies you, such as your name, address, phone number, fax number, and email address, as well as sensitive information you provide, such as credit card details, financial account information, and Grade Point Average information.
